What is Maintenance?


Maintenance is paid by one of the parents of a ​minor. It can be a lump sum payment or a ​periodical payment of money to care for the ​minor children (under 18) of the family.

Why pay Maintenance?



Maintenance is necessary to cover the cost of daily ​living and general upkeep and educational costs or ​minor child/children.

Maintenance is paid usually by the parent who does ​not have the responsibility of the day to day care of the ​minor child/children.


Maintenance payments may be decided upon by the ​parents and in the event the parents cannot agree, ​payments are decided by the court in the form of a ​maintenance order.

Who can apply for Maintenance?


Any parent or guardian can apply for maintenance. ​However... They must be a resident of Trinidad and Tobago ​They must have care and control of the minor child/children. ​They must need financial assistance for the minor ​child/children. Guardians applying must prove that the ​minor child/children is in their care and custody

All parents have a duty to maintain their children. This ​applies regardless of their marital/relationship status.

Where to apply for Maintenance?


An application for maintenance can be made at the ​Family Court of Trinidad and Tobago. The applicant can ​make the application in the Magistrates Court. OR

If you reside in the St. George West District (from ​Chaguaramas to Mt. Lambert) then you can file an ​application in the Magisterial jurisdiction.

Points to note


  • Where an agreement is reached between the parties there may be no need ​to go to court. If you do not go to court, however, the agreement may not be ​legally binding.
  • The maintenance order can be varied
  • The maintenance order remains in force until the child turns 18 years old.
  • There is no time limit to apply for maintenance
  • An application for maintenance can be made even where the child is not the ​biological child of the ex, once they are a child of the family( Family Law Act ​s24(b)
  • Where the person applying remarries or are in another relationship you will ​NOT be entitled to apply for maintenance.
  • Maintenance can be applied for where the parties are NOT separated and ​one partner witholds funds per the Family Law Act Ch 46:08 s13(3) and s24.

When your ex refuses to pay maintenance ordered by the ​court

  • You may return to court after the passing of (1) one month and ​bring them to court by either:
  • A Maintenance warrant of Apprehension “Warrant of Arrest” is ​taken out after (4) weeks (one month)of consistent non-payment.
  • A Committment Warrant. Applicable where time has been given to ​allow the payment of the outstancing balance by a specific ​deadline on the order. Where the deadline passes without full ​payment, the respondent must pay the full balance of be sent to ​prison with no hearing.

1.Contact the Family Court: The first step is to contact the Family Court in your area to get information about the specific procedures and requirements for obtaining a protective order for a minor.



2. Fill out the necessary forms: The court will provide you with the necessary forms to fill out to apply for a protective order for a minor.
